Welcome to SpeakUp AI. These Terms of Service ("Terms") govern your use of the SpeakUp AI mobile application ("App") operated by Jun Software ("we", "us", or "our"). By using the App, you agree to these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

SpeakUp AI is an AI-powered English learning application that provides:

• Conversational practice with AI tutors
• Pronunciation evaluation and feedback
• Personalized learning paths based on your proficiency level
• Progress tracking and performance analytics

3. Account Registration

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information during registration.
• You are responsible for all activities that occur under your account.

4. Subscription and Payments

4.1 Free Plan

The App offers a free tier with limited daily conversations and basic features.

4.2 Pro Subscription

• Pro subscriptions are billed through Apple's App Store.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your Apple ID account settings.

4.3 Free Trial

• If offered, a free trial provides full Pro access for a limited period.
• You will be charged the subscription price when the trial ends unless you cancel beforehand.
• Each Apple ID is eligible for one free trial only.

4.4 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple's support. We do not process refunds directly.

5. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Use automated tools, bots, or scripts to interact with the App
• Share your account credentials with others
• Upload or transmit harmful, offensive, or inappropriate content
• Attempt to circumvent subscription restrictions or access controls
• Use the App to generate content that violates any third-party rights

6. AI-Generated Content

• AI responses are for educational purposes only and should not be relied upon as professional language certification or assessment.
• Pronunciation scores and feedback are approximations and may not reflect formal linguistic evaluation standards.
• We continuously improve our AI models but do not guarantee error-free output.

7. Intellectual Property

• The App, including its design, code, AI models, and content, is owned by Jun Software and protected by intellectual property laws.
• You retain ownership of any original content you create while using the App (e.g., your voice recordings).
• You grant us a limited license to process your voice recordings solely for providing the App's services.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

• We do not guarantee uninterrupted or error-free service.
• We do not guarantee specific learning outcomes or English proficiency improvements.
• Service availability may vary by region.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUN SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

11. Termination

• You may stop using the App and delete your account at any time.
• We may suspend or terminate your account if you violate these Terms.
• Upon termination, your right to use the App ceases immediately.
• Sections on intellectual property, disclaimers, and limitation of liability survive termination.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App. Your continued use after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles.
